Insightful Psychics Terms Of service (revised April 3rd, 2009)

GENERAL TERMS APPLICABLE TO ALL MEMBERS

These terms apply to the Insightful Psychic web site, chat rooms and future additions.Your use of the Insightful Psychic website, chat rooms and message boards are subject to these membership terms and conditions.

YOUR MEMBERSHIP.

Your membership, which includes access to the chat rooms and all other private areas of the site takes the form of a non-transferable license to use these services and can be revoked by the  Insightful Psychics owners for serious or persistent failure to abide by these terms and conditions.By gaining access to and logging into any members area:You confirm that you are 18 or over 18 years of age.You agree you have read and understood and agree to abide by these terms and conditions before you make your decision to become a member of the chat rooms and message boards. You agree you have read and understood our privacy policy.

YOUR RESPONSIBILITY

You agree to taking full responsibility for your actions in joining the member's areas of the site and will not take any legal action against the webmaster/host, or any other connected parties, based on your decision to join. To become a member of the chat rooms and message boards you must register with us and agree to provide accurate, current and complete information about yourself as prompted by our registration form. We rely on the information provided when you register to be accurate, current and complete and if you submit information that is untrue, inaccurate, not current or incomplete in any respect, we reserve the right to terminate this agreement and your use of the chat rooms. As a member of the chat rooms and message boards, you are solely responsible for your own communications and are responsible for the consequences of them. You are also solely responsible for maintaining the confidentiality of your username, password and e-mail address and all activities that are conducted through your account.You are solely responsible for your interactions with other members.In consideration of being allowed to use the chat rooms, you agree that you will abide by the Code of Conduct and in general will not:

(a) Harass any other member or member of staff.

(b) Use the chat rooms and message boards for any purpose in violation of local, state, or national laws of any country.

(c) Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.

(d) Post material that is abusive, defamatory, embarrassing, harassing, hateful, inflammatory, obscene or threatening to any other member or member of staff.

(e) Post sexually-explicit language or images.

(f) Post advertisements or solicitations of business.

(g) Post chain letters or pyramid schemes.

(h) Impersonate another member or member of staff.

(i) Express or imply that any statements you make are endorsed by Insightful Psychics or its staff, without our specific written consent.

(j) Collect or store personal information about other members without their personal consent.

Non-commercial Use by Members.The Insightful Psychics Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Insightful Psychics. Illegal and/or unauthorized use of the Insightful Psychics Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Insightful Psychics Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation will result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the Insightful Psychic Services and chatroom. If you breach this Agreement and send unsolicited bulk email, instant messages or other unsolicited communications of any kind through the illegal gathering of emails from using the insightful psychics Services, you acknowledge that you will have caused substantial harm to insightfulpsychics.com, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay insightfulpsychics.com $50 for each such unsolicited email or other unsolicited communication you send through the use of insightfulpsychics.com and there here in services due to the breach of the rules set forth.

CHAT RULES
The following chat rules are for the protection of the site and the clients of Insightful Psychics. By following these modest rules it will insure the longevity of your stay on our website.

Only the readers of Insightful Psychics are allowed to do readings, anyone else found doing readings will be banned perminently.

There is to be no exchanging of E-mail addresses,any online messenger programs (AIM, ICQ, YAHOO, MSN etc), social networking sites or myspace.com profiles in the chat on Insightful Psychics. This includes but not limited to refering someone to add you from our page giving your name to look for. This will be strickly enforced for the following reasons:

1) to protect you the clients of Insightful Psychics from being stalked by another that could be out to cause harm, as well as to cut down on hacker related problems.
 2) to protect the website from any problems that could arise from issues concerning what was said in section 1.
 3) to protect the website from someone email harvesting and using said emails for promotional use.

The Webcam feature that is available on Insightful Psychics, Is only for the staff of the site. Anyone else that is found on the cam's will be banned from the site permanently. The chatroom logs all instances of webcam access.
 
You can only use one username per Internet Address (IP) account. Any instance of using 2 accounts to gain 
readings will result in being banned.

We ask of you that while you are on Insightful Psychics please refrain from rude remarks, or fighting with other members of the site. We want to keep the site as a warm, relaxing, and peaceful place for one and all to come to, without the hassles of everyday life.

Please refrain from mentioning any other website or company while on Insightful Psychics that is directly involved or similar to the content of the website... This rule is made just out of the respect of the service we provide... Any abuse against this rule will result in the ISP (Internet Service Provider) of the client banned for an undetermined amount of time.

No fraud of any kind will be tolerated. Please do not make any charge backs of your purchase. If you had a problem at anytime with the reading you purchased please contact support  and someone will get back to you and help remedy the situation. Insightful psychics will be working with Internet service providers (ISP), and legal agencies from around the world to prosecute all instances of identity theft, credit card, or online fraud of any kind.

No discussions about home locations or personal meetings with the psychics. Just like how we want you to feel comfortable in the rooms, we also want to give the psychics the same level of comfort. If any excessive sign of stalking occurs the information will be turned over to the proper authorities.

No recruiting of any kind can be done on the site for personal, professional, website or other reasons. Any instances of this will be reason for a permanent banning.

All information that is collected on the site will be 100% confidential and will never be released or sold to anyone at any time, for any reason what so ever.

YOUR ACKNOWLEDGEMENTS

You acknowledge and understand that your use of the chat rooms and message boards provided by Insightful Psychics is at your sole risk.You acknowledge it is possible that from time to time other members or visitors may post offensive comments in the chat rooms or on the message boards and that you may be involuntarily exposed to offensive comments before we have the opportunity to remove them. You acknowledge that neither Insightful Psychics or its staff are not responsible for the use of any personal information that you may choose to disclose in the chat rooms or on the message boards. You acknowledge that neither Insightful Psychics does not screen the chat rooms in advance and are not responsible for monitoring material posted by members. Insightful Psychics does not represent or guarantee the truthfulness, accuracy or reliability of any material posted by members or endorse any opinions expressed by members. You acknowledge that any reliance on material posted by other members will be at your own risk. You acknowledge that Insightful Psychics may provide links to other web sites. Because the Psychic site has no control over such sites you acknowledge and agree that neither site is responsible for their content.

RIGHTS OF THE INSIGHTFUL PSYCHICS  WEB SITE

Insightful Psychics reserves the right to change in any way the use and availability of any of the chat rooms or the message boards at our sole discretion including these terms and conditions. If notified by a member of postings which allegedly do not conform to these terms and conditions Insightful Psychics may investigate the allegation and determine in good faith and at our sole discretion how to deal with such matters.
Insightful Psychics has no liability or responsibility to members for performance or non-performance of monitoring activities within the chat rooms.Insightful Psychics reserves the right to suspend or expel members and prevent their further access to the chat rooms  for violating these membership terms and conditions, or the Code of Conduct or the law.
Insightful Psychics reserve the right to remove postings which are abusive, illegal, defamatory, disruptive or otherwise contravene the Terms and Conditions, the Code of Conduct or the Ethics of Reading. Insightful Psychics retains the right to terminate your membership and rights to use the chat rooms and message boards at anytime without cause, and without any liability to you.

SERVICES

Insightful Psychics has the right to change, add, or subtract any services on the website at anytime without warning. In the case of private readings that are booked such items are safe on the website as they are the anchor items on the site. Anything else requiring registration for, if terminated will result in a full refund with suficient notice of the termination. Insightful psychics also reatains the right to change the pricing at anytime to refect the current trend in the industry. Any private readings purchased before a price change will be greatfully accepted at the value it was set for when purchased. When purchasing private readings the total amount of minutes purchased must be used up with that same psychic reader and not transfered to another but you retain the right to inform the reader before hand that you plan on only using a certain amount and deam an alotted time for a future occasion.

The chatroom is done on a per user basis. When a Psychic is in the room terms are their rules governed by the site rules. When a reader is in chat your name will be put on a list when you came in the room. If a private readng is bought the reader will go ahead and complete the reading moving the reading ahead of any " free" questions in line. If the readers timeframe for their schedule is completed then the reader is not held responsible for any " free" questions that were not completed.

INDEMNITY

You agree to indemnify and hold insightfulpsychics.com, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the insightful psychics Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Insightful Psychics Website or through the Insightful Psychics Services causes insightfulpsychics.com to be liable to another.

Use of Insightful Psychics services constitutes acceptance of the  Chat Rules and terms of service.
